April 2017      Workers’ Compensation Settlement for $450,000.00

The employee was working as a registered nurse in an intensive care unit of a large community hospital. As is common in such units, she and several other staff were lifting an obese patient. As she did so, she experienced sudden and immediate severe spasm accompanied by back pain which radiated down her leg. She was initially diagnosed with a back strain and treated with medications and physical therapy. After the passage of about 10 months when she had not improved, she sought a second opinion with a doctor in a Boston teaching hospital. Two months later, after additional diagnostic testing, she underwent back surgery including fusions of two levels of her lumbar spine. The employee continued to have significant back complaints and was referred to pain specialists and her primary care physician for ongoing medical management.

The workers compensation insurer initially paid the employee total disability benefits. However, before the exhaustion of the initial six month period during which liability does not attach to the insurer, the employee, who did not have legal representation at the time, agreed to an extension of the six month period of non liability. The insurer then reduced her weekly benefit payments based upon a partial disability status. The employee sought the services of Brian Cunha & Associates and a claim was immediately filed on her behalf. Eventually, through a series of appearances before the Department of Industrial Accidents’ court, we obtained a judicial Order for an award of permanent total disability benefits. We were also able to obtain the insurer’s agreement to pay a retroactive adjustment of unpaid benefits covering the period during which the employee received reduced partial disability benefits. Thereafter, negotiating for the employee, we were able to obtain a settlement offer which the employee accepted.

A Superior Court judge has found that the owners of land in Newport can be sued for accepting a competing offer one day after agreeing to sell the property to a couple. The plaintiff buyers claimed that the defendant sellers committed slander of title and violated Rhode Island’s Deceptive Trade Practices Act. Judge Walter R. Stone denied the defendants’ motion for summary judgement.
