Use of Cell Phone to Video-Tape Police Officers Allowed

8/26/11- In a resounding decision, protecting the rights of our countries citizens,  the 1st Circuit Court of appeals, sitting in Boston, Massachusetts, has affirmed a lower court ruling that a citizen has the right to use his cell phone to video-tape a police officers misconduct during an arrest,  but also that the arrest of the citizen cell phone user was illegal and violated the constitution.

The citizen was arrested for openly using his cellphone to record the police making an arrest on Boston Common. He was charged with, among other things, illegal wiretapping. For a copy of the full decision in pdf format… See attached.
